Terms of Service

1. Agreement

These Terms of Service apply to your use of VitalScan: Heart Rate Monitor and its related features. By using the app, you agree to these Terms and applicable requirements. Do not use the app if you do not agree. Apple terms that apply to your download or use remain in effect.

2. Eligibility and acceptable use

Use the app lawfully and provide information that is accurate and that you are authorized to provide. Scan yourself, or obtain the scanned person's informed consent before scanning someone else. Do not use the app for covert monitoring, identifying another person, unlawful activity, or interference with the service.

3. Wellness purpose and limitations

VitalScan provides general wellness estimates and record management. It is not for diagnosing, treating, preventing, or monitoring a disease or emergency, and it is not for medical decisions. Estimates are affected by lighting, movement, camera characteristics, face position, and individual differences. Results contain measurement error and are not guaranteed to be generated on every scan. A missing reading does not indicate that your health is normal.

Do not change medication, delay medical care, or rely on the app in an emergency based on a result. Consult a qualified healthcare professional when needed.

4. Features and requirements

Face scans use the camera and an online VitalLens service to estimate heart rate, respiratory rate, and HRV SDNN. BMI and waist-to-height ratio are calculated on your device from information you enter. Apple Health access is read-only and requires your permission. Local reminders require notification permission. You can export records as CSV or JSON. VitalScan does not provide disease-risk predictions, blood glucose or blood pressure measurements, clinical accuracy claims, or a guaranteed scan completion time.

A face scan requires camera permission, a compatible device, an internet connection, and the VitalLens service.

5. App license

Subject to these Terms and applicable requirements, you may use the app for personal, non-commercial purposes on a compatible device that you own or control, in accordance with Apple's usage rules. The app and its branding are protected by applicable intellectual property laws. Do not resell access, misuse the service, bypass restrictions, infringe others' rights, or interfere with security. Restrictions on reverse engineering apply only to the extent permitted by law.

Where Apple's standard license applies to your download, it also governs your use of the app: Apple's Standard License Agreement. These Terms do not waive rights that cannot be waived under applicable law.

6. Records and privacy

Profiles and measurement reports are stored locally on your device. VitalScan does not provide user account registration, report cloud backup, or report syncing. You can edit your profile, export records, delete an individual report, or delete all measurement history. Deleting measurement history keeps your profile and settings. Removing the app or clearing its local data makes local reports inaccessible. Exported copies and source data in Apple Health are managed by their respective recipients or services and are not automatically deleted when you clear local history.

7. Third-party services

VitalLens provides the face-scan service. Apple provides iOS permissions and Apple Health features. Use of these services is subject to their applicable terms. Face scans depend on the VitalLens service. Third-party names and links identify the services and do not imply endorsement or clinical certification.

8. Maintenance and user rights

We update the app and adjust features for maintenance, security, and compliance. We may restrict use in response to unlawful activity, service abuse, or security risks. These Terms do not exclude liability or remedies that applicable law does not allow to be excluded.
